Terms of Service

These terms govern any shoot booked with Ian K Captures ("we," "us," "our") for real estate photography, video, floor plan, virtual staging, or related media services. By booking a session, you agree to the terms below.

Booking & scheduling

Shoots are booked through our online scheduling page. A confirmed booking reserves a specific date and time for your property. Please provide accurate property access details (address, entry instructions, and a point of contact if you won't be present) so the shoot can start on time.

Payment

Pricing for each service tier is listed on our site at the time of booking. Payment is due via invoice on the day of the shoot, before we leave the property. If you or your representative won't be on-site during the shoot, payment must be received before we arrive. Prices may change for future bookings but never for a shoot you've already confirmed.

Rescheduling & cancellations

Real estate media is weather- and access-dependent, so reasonable flexibility runs both ways:

• You can reschedule or cancel at no charge, at any notice. We just ask for at least 24 hours' notice when possible so we can offer that time to another client.
• If we need to reschedule due to weather, illness, or another factor outside our control, we'll offer the next available time at no extra cost to you.
• If we arrive and can't access the property at the scheduled time through no fault of ours, we'll work with you to find the next available time.

Photo & video ownership and usage rights

Ian K Captures retains copyright ownership of all photos, video, floor plans, and other media we produce. When you book and pay for a shoot, you receive a license to use the delivered media for marketing and promoting that specific property listing — including MLS listings, social media, print materials, and your own website.

This license does not include the right to resell the media, use it to market a different property, or claim authorship of the work. If you'd like an extended or exclusive license beyond marketing the listing itself, contact us to discuss terms.

Ian K Captures retains the right to use any photos, video, and other media from every shoot — including yours — in our own portfolio, website, Google Business profile, social media, business cards, pamphlets, and other advertising and marketing materials promoting our services. This right is part of every booking and does not require further permission from you.

Property access & liability

By booking a shoot, you confirm you have the authority to grant us access to the property for the purposes of photography and videography. We carry standard care and caution while on-site, but we are not responsible for pre-existing property conditions, and our liability for any claim related to a shoot is limited to the amount paid for that session.

Weather & drone services

Any drone (aerial) services are flown in accordance with FAA regulations and are subject to cancellation or rescheduling due to weather, airspace restrictions, or safety conditions at our discretion, at no charge to you.

Changes to these terms

We may update these terms as our services or the law change. The "last updated" date above reflects the most recent revision. Terms in effect at the time you book apply to that booking.

These terms are a general framework, not a substitute for legal advice. If a specific shoot needs custom terms (an exclusive license, an extended cancellation window, and so on), we're happy to put that in writing separately.
